Crymes Landfill, Gwinnett County, Georgia - Represented 44 companies in Georgia’s first multi-party superfund site involving generators and transporters. Negotiated a Corrective Action Plan which saved the clients more than $20 million in remediation costs. Mediated a settlement between the 44 parties regarding the amount each party would pay and a buyout agreement for parties with smaller volumes.
SP Newsprint, Dublin, Georgia - Negotiated settlement of a claim by a citizens’ group that discharges from SP Newsprint were violating the Clean Water Act. Settlement involved no penalty and provided that the environmental group would not seek to change the company’s existing permit.
AER Site, Augusta, Georgia - Organized a group of 45 parties and negotiated a consent order with EPA to conduct an investigation of contamination at the AER site. Facilitating final allocation of costs of the work.
LWD Site, Calvert City, Kentucky - Organized a group of 54 former customers of the LWD site and negotiated a consent order with EPA to allow the group to take over the cleanup of the site. Organizing over 100 additional parties to participate in a comprehensive settlement.
Constitution Road Site, Atlanta, Georgia - Organized a group of 85 parties and negotiated a consent order which obtained forgiveness of more than $3 million of EPA past costs in exchange for agreement of the 85 parties to cleanup the site for less than the past costs claim that EPA gave up in the settlement.
Brownfield Cleanups - Representing the following companies in brownfield agreements and transactions involving purchase and sale and cost effective cleanup of contaminated property: General Electric, ARAMARK, Ashland, Novare, Jamestown, Roper, The Coca Cola Company, Ford, General Motors, Oakmont, The Georgia Tech Foundation.
