Mr. Bayman’s recent legal experience includes: 

  • Representation of pharmaceutical, medical device and foreign automobile manufacturers in product liability lawsuits.  His clients have included GlaxoSmithKline, Merck, Olympus, Eli Lilly, Toyota, Nissan, Porsche, Mercedes-Benz, Isuzu, Mazda, Subaru, Kia, Medtronic Sofamor Danek, Weyerhaeuser, Packaging Corporation of America, and Club Car, among others.   

  • Member of a King & Spalding team that is serving as national coordinating counsel and trial counsel in product liability litigation involving GSK’s antidepressant, Paxil®, including in the Philadelphia Court of Common Pleas Mass Tort Program, ranked number one in the American Tort Reform Association’s 2010 list of “Hellhole Jurisdictions.”  King & Spalding has been successful in defeating certification of both state and national classes of Paxil® consumers on consumer fraud, medical monitoring and personal injury allegations.  Those MDL victories, In Re Paxil Prods. Liab. Litg. 218 F.R.D. 242, 203 U.S. Dist. LEXIS 21195 and 212 F.R.D. 539, 2003 U.S. Dist. LEXIS 1936 have been referred to as part of the “big four” pharmaceutical cases on denial of class certification and medical monitoring and consumer fraud cases.  See In Re Prempro Prods. Liab. Lit., 2005 W.L. 2094974 (E.D. Ark. Aug. 30, 2005) fn. 78.

  • Served as national coordinating counsel for a large consumer healthcare product manufacturer and has supervised a national document collection and company-wide interviews for that client. 

  • Represented a major medical device manufacturer as national coordinating counsel and lead trial counsel in product liability litigation involving a recalled medical device.  Mr. Bayman has represented the company in class actions and individual lawsuits alleging death or serious injury due to a defect in the device. 

  • Lead trial counsel or second chair trial counsel in 14 automotive product liability cases and in a dealership termination trial in the federal and state courts in Georgia, Mississippi and Alabama.

  • Achieved defense verdict for Nissan as trial counsel in the first-ever case tried involving an alleged defect in a motorized seatbelt system (Smith-Green v. Nissan). 

  • Served as national trial counsel for Quest Diagnostics Incorporated, the country’s largest private clinical laboratory company, in lawsuits arising out of the interpretation of laboratory specimens.

  • Lead trial counsel in cases in Missouri and Ohio in which it was alleged that a misread Pap smear led to a delay in the diagnosis of cervical cancer and caused wrongful death and the loss of fertility.

  • Has argued before the Tenth Circuit, Eleventh Circuit and in the appellate courts of Georgia.  Obtained a successful result as lead appellate counsel on behalf of Mazda in the case of James v. Mazda Motor Corporation, et. al., 222 F.3d 1323 (11th Cir. 2000).  The court held that a claim that a vehicle was defective because it failed to incorporate an automatic lap belt was preempted.
