Katie McCarthy to Present at PLI’s 2012 Intellectual Property Law Institute

NEW YORK, September 5, 2012 – Kathleen M. McCarthy, a partner in King & Spalding’s intellectual property practice in New York, is scheduled to present a day-one breakout session on Trademarks as part of the Practising Law Institute’s (PLI) “Intellectual Property Law Institute 2012”. The annual event will take place September 13-14 at PLI’s conference center in New York City.

McCarthy’s session will provide an update on keyword advertising, including a discussion of the Fourth Circuit decision in Rosetta Stone v. Google. In addition to providing participants with a general update on the state of the law, her presentation will also address:

  • Search engine liability: Are the search engines stoppable in selling keywords?
  • Notice and takedown: Does the search engine have any duty to act as an Internet police force?
  • Use of keywords by counterfeiters vs. use of keywords by competitors: Does it make a difference? Should it make a difference?

McCarthy will also highlight facts from recent cases between competing advertisers that may help identify what actions are likely to be found infringing and provide an analysis of how Europe and the United States differ in their approach to assessing keywords.

McCarthy has twenty-four years of experience in litigation and related counseling in domestic and international trademark, copyright, false advertising, right of publicity, unfair competition and internet matters. She has first-chaired numerous trials and preliminary injunction hearings and has practiced in the federal courts, the U.S. Patent and Trademark Office Trademark Trial and Appeal Board, the International Trade Commission, and ICANN domain name arbitrations. In addition to litigation and contested matters, McCarthy also directs international and domestic trademark clearance and prosecution programs.
