On Thursday, January 12, 2012, we will be hosting a Roundtable Webinar to discuss the requirements and implications of the recently released proposed rule implementing the federal Physician Payments Sunshine provisions (the “Sunshine Provisions”). Leading the Roundtable will be Seth H. Lundy and Brian Bohnenkamp of our Washington, D.C., Office.
The Centers for Medicare and Medicaid Services (“CMS”) issued a proposed rule to implement the Sunshine Provisions on December 14, 2011. The Sunshine Provisions, Section 6002 of the comprehensive Patient Protection and Affordable Care Act enacted in March 2010, require certain pharmaceutical, biologic, and medical device manufacturers to annually report to CMS payments or other transfers of value they furnish to physicians and teaching hospitals. In addition, the law requires certain manufacturers and group purchasing organizations (“GPOs”) to report ownership or investment interests in their organizations held by physicians. CMS is required to make publicly available through a searchable website information manufacturers and GPOs submit in transparency reports.

- Timing for implementation of the Sunshine Provisions and reporting of financial information
- Who is required to file reports
- How “physicians” and “teaching hospitals” are defined
- What types of payments will be reported
- How the reports are likely to look
- Insights into key issues and questions likely to arise as a result of implementation
- The process for filing timely comments to the proposed rule
